The State of Georgia HB 845 went into effect on July 1, 2014. It states that when an individual requests a booking photograph, that the individual 'shall' submit a statement affirming that the photograph will not be placed in a publication or placed on a website that requires a fee for removal of the said photograph. Therefore any individual, whether it is a private citizen, a representative of a media organization or representative of any business, must accurately and legibly complete and sign an affirmation statement.
INSTRUCTIONS: To obtain a booking photograph, print off a copy of the Henry County Sheriff's Office "Letter of Affirmation" and complete it as directed in the letter. There are currently three options to return your affirmation for entry into our records for future reference:
1. Mail it to the address on the bottom of the letter "Attention - Jail
2. Fax it to 770-288-7163 address to "Jail Administration - Affirmation Letter"
3. Drop it off at the Sheriff's Office at the address on the bottom of the Letter
Any person who knowingly makes a false statement in requesting a booking photograph shall be guilty of a violation of O.C.G.A. § 16-10-20.
